PICKMASTER — TERMS OF USE

These Terms of Use (“Terms”) govern access to and use of PickMaster, including its website, applications, prediction challenges, leaderboards, communities, prizes and related services (“PickMaster” or the “Platform”).
PickMaster is operated by [COMPANY LEGAL NAME], a company organized and existing under the laws of the Republic of El Salvador (“Company,” “we,” “us,” or “our”).
By accessing or using PickMaster, you agree to these Terms and, where applicable, to the Official Rules governing a particular contest or promotion.
IMPORTANT NOTICE
PICKMASTER IS A FREE-TO-PLAY SPORTS PREDICTION AND ENTERTAINMENT PLATFORM.
PICKMASTER DOES NOT ACCEPT SPORTS BETS OR WAGERS.
USERS DO NOT STAKE MONEY ON THEIR PREDICTIONS.
AN INCORRECT PREDICTION DOES NOT CAUSE A USER TO LOSE MONEY TO PICKMASTER OR TO ANOTHER PARTICIPANT.
Prizes, where offered, are provided by the Company, sponsors, creators, partners or another identified prize provider according to the applicable Official Rules.
1. ABOUT PICKMASTER
PickMaster allows eligible users to make predictions regarding objectively verifiable events and outcomes.
Predictions may concern motorsports, sports, entertainment or other subjects permitted by the Platform.
Users may receive points according to the accuracy of their predictions and may compete on leaderboards or within communities.
Certain competitions may award prizes.
2. NO SPORTS BETTING
PickMaster does not operate as a sportsbook.
Users cannot:
- place a monetary bet through PickMaster;
- stake money on an outcome;
- wager a Velox collectible;
- wager cryptocurrency;
- stake property against another user;
- lose an entry stake because of an incorrect prediction; or
- receive winnings calculated according to betting odds or the amount wagered.
PickMaster does not accept participant funds for placement at risk on sporting outcomes.
3. FREE-TO-PLAY PARTICIPATION
PickMaster is designed as a free-to-play Platform.
The Company may establish different types of contests, communities and eligibility requirements.
Where applicable law, regulatory authorization or the Official Rules require a particular method of free participation, PickMaster will make such method available.
4. VELOX AND PICKMASTER ARE DISTINCT SERVICES
Velox and PickMaster may interact technologically and commercially but perform different functions.
Velox provides digital collectibles and associated functionality.
PickMaster provides predictions, challenges, communities and contests.
A payment made to acquire a Velox collectible constitutes payment for the applicable collectible and its associated content, rights or functionality.
It is not a wager made through PickMaster.
5. USE OF VELOX COLLECTIBLES
Velox collectibles may be used within PickMaster to:
- make or visually represent predictions;
- access communities;
- unlock non-prize features;
- identify memberships;
- customize user experiences;
- access creator-specific experiences; or
- provide other functionality described by the Platform.
The conditions under which possession of a particular Velox collectible may interact with a prize-bearing competition will be specified in the applicable Official Rules and will be structured subject to applicable law and regulatory authorization.
6. OFFICIAL RULES
A prize-bearing contest may be governed by separate Official Rules.
Official Rules may specify:
- sponsor and organizer;
- purpose of the promotion or contest;
- promotional period;
- participants;
- geographic eligibility;
- method of participation;
- prediction deadlines;
- scoring;
- prizes;
- winner-selection methodology;
- tie-breaking procedures;
- winner notification;
- prize-claim procedures;
- unclaimed prizes;
- restrictions;
- taxes; and
- any required regulatory authorization.
The Official Rules form part of the agreement governing participation in that contest.
Where contest-specific provisions conflict with these Terms, the Official Rules control regarding that contest.
7. REGULATORY AUTHORIZATION
Certain contests, competitions, trivia activities, promotions, prize programs or similar activities may require authorization by the Ministerio de Gobernación y Desarrollo Territorial of El Salvador or another competent authority.
Where authorization is legally required, the Company will condition the promotion, advertising or operation of the applicable activity on obtaining the required authorization.
The Company may delay, modify, restrict or cancel an activity if required for regulatory compliance.
8. ELIGIBILITY
Unless otherwise stated in the Official Rules, participants in prize-bearing contests must be at least 18 years old.
A contest may also be restricted by:
- country;
- state;
- province;
- territory;
- age;
- residency;
- sanctions restrictions;
- regulatory requirements; or
- other legal eligibility conditions.
Access to the PickMaster website does not automatically mean that every contest is legally available to every user.
9. INTERNATIONAL USERS
PickMaster may be accessible internationally.
However, eligibility for prizes may vary by jurisdiction.
The Company may:
- exclude particular jurisdictions;
- restrict particular prizes;
- offer different versions of a contest;
- impose additional verification;
- provide jurisdiction-specific rules; or
- geoblock access where reasonably necessary.
Users are responsible for complying with laws applicable to them.
10. ACCOUNTS
Users may be required to create an account.
Users must provide accurate information and maintain account security.
Unless expressly permitted, one individual may not use multiple accounts to increase entries, manipulate rankings or obtain an unfair competitive advantage.
11. IDENTITY AND RESIDENCY VERIFICATION
Prize winners may be required to establish:
- identity;
- age;
- residency;
- country of participation;
- eligibility;
- tax information; or
- other information reasonably required by law or the Official Rules.
A prize will not be considered finally awarded until verification has been completed where required.
12. PREDICTIONS
Predictions must be submitted before the applicable deadline.
The Platform may automatically lock predictions at a predetermined time.
After locking, predictions may not be changed unless the applicable rules expressly permit modification.
The Platform’s electronic records will be used to determine submission time.
13. SCORING
Scoring criteria will be published before the relevant prediction closes.
Depending on the competition, points may be awarded for predicting matters including:
- finishing positions;
- qualifying outcomes;
- podiums;
- fastest laps;
- eliminations;
- statistical results;
- positions gained or lost;
- retirements;
- head-to-head results; or
- other objectively verifiable events.
14. OFFICIAL RESULTS
PickMaster may use data from official sporting bodies, recognized data providers or other sources designated in the Official Rules.
If an official result is corrected, amended or disqualified after an event, PickMaster may modify its scoring according to the rules established for that contest.
15. LEADERBOARDS
Participants may be ranked according to accumulated points or other published criteria.
Leaderboard information may remain provisional until results and eligibility have been verified.
Appearing first on a leaderboard does not by itself constitute final confirmation of a prize.
16. PRIZES
PickMaster may offer prizes including:
- cash;
- digital collectibles;
- physical products;
- experiences;
- memberships;
- promotional benefits; or
- other items identified in the Official Rules.
Prize pools are not formed from user wagers.
Prizes may be funded by:
- the Company;
- a sponsor;
- an influencer or creator;
- a commercial partner; or
- another disclosed prize provider.
17. CASH PRIZES
Where permitted by law, certain contests may award cash prizes.
The amount, currency, payment method and applicable conditions will be disclosed in the Official Rules.
Users do not acquire any right to a cash prize merely by participating.
A prize becomes payable only after the winner has been determined and, where applicable, verified.
18. CREATOR COMMUNITIES
PickMaster may operate communities associated with creators, influencers, media outlets, brands or other partners.
A creator may have a dedicated PickMaster community or contest.
Unless expressly stated otherwise, the existence of such a community does not mean that the creator:
- operates PickMaster;
- holds participant funds;
- determines official scoring;
- controls winner verification; or
- is responsible for paying prizes.
The applicable Official Rules will identify the sponsor and prize provider where relevant.
19. TIES
Tie-breaking rules will be disclosed in advance where relevant.
Tie-breakers may include objective additional criteria or another method established in the Official Rules.
20. EVENT CHANGES
Sporting events may be:
- postponed;
- delayed;
- cancelled;
- shortened;
- abandoned;
- rescheduled;
- altered; or
- subject to official result changes.
The applicable Official Rules will determine how such events affect scoring and prizes.
21. FAIR PLAY
Users must participate fairly.
The following are prohibited:
- unauthorized multiple accounts;
- identity falsification;
- unauthorized automated entries;
- collusion;
- manipulation of scoring;
- exploiting Platform vulnerabilities;
- bypassing deadlines;
- falsifying location;
- circumventing geographic restrictions;
- fraudulent prize claims; or
- other conduct designed to obtain an unfair advantage.
22. DISQUALIFICATION
The Company may disqualify a participant or entry where there is reasonable evidence of:
- fraud;
- manipulation;
- legal ineligibility;
- breach of Official Rules;
- use of multiple unauthorized accounts;
- abuse of Platform systems; or
- another material violation of these Terms.
23. TECHNICAL ERRORS
The Company may correct clear technical, scoring, display or administrative errors.
This may include incorrect:
- points;
- leaderboard positions;
- duplicate entries;
- official results;
- prize displays; or
- data feeds.
Corrections will be made consistently with the applicable Official Rules and applicable law.
24. TAXES
Prize recipients are responsible for taxes legally imposed upon them unless applicable law provides otherwise.
The Company may require tax information or make legally required reporting or withholding.
25. UNCLAIMED PRIZES
The treatment of unclaimed prizes will be established in the applicable Official Rules and any required regulatory authorization.
Where required, such rules may identify the deadline for claiming a prize and its destination if it is not claimed.
26. INTELLECTUAL PROPERTY
PickMaster software, interfaces, branding, scoring systems, graphics and proprietary materials are owned by or licensed to the Company.
Users receive only a limited personal right to use the Platform in accordance with these Terms.
27. MOTORSPORT DISCLAIMER
Unless expressly stated in connection with a licensed or sponsored activity, PickMaster, Velox and the Company are independent and are not affiliated with, sponsored by, endorsed by or officially connected with Formula 1, the FIA, Formula One Management, Formula One Licensing, Formula One teams, drivers or other motorsport rights holders.
Third-party marks and intellectual property belong to their respective owners.
28. SERVICE AVAILABILITY
We do not guarantee uninterrupted access.
Technical outages, telecommunications failures, third-party data failures, cybersecurity events or circumstances outside our reasonable control may affect the Platform.
The Company will use reasonable measures to preserve contest integrity.
29. RESPONSIBLE USE
PickMaster is intended for entertainment.
Participants should not purchase products, incur expenses or make financial decisions based upon an expectation of winning a PickMaster prize.
30. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special or consequential damages arising from use of PickMaster.
Nothing in these Terms excludes liability or mandatory consumer rights that cannot legally be waived.
31. CHANGES TO THE PLATFORM
The Company may alter Platform functionality, prediction formats, scoring structures or other features.
After a contest has begun, material rules affecting the determination of winners will not be changed except where:
- expressly contemplated by the Official Rules;
- required by law or a competent authority;
- necessary to address an error; or
- necessary because of circumstances outside the Company’s reasonable control.
32. CHANGES TO THESE TERMS
We may amend these Terms from time to time.
Material changes will be communicated through reasonable means and will apply prospectively unless applicable law requires otherwise.
33. CONSUMER PROTECTION
Nothing in these Terms is intended to waive any mandatory right granted under the consumer-protection laws of El Salvador or other mandatory consumer law applicable to a particular user.
34. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Republic of El Salvador, without prejudice to mandatory legal protections applicable in another jurisdiction.
35. JURISDICTION
Subject to mandatory consumer laws, disputes arising from PickMaster shall be submitted to the competent courts and authorities of the Republic of El Salvador.
36. SEVERABILITY
If a provision is held invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.
37. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, applicable Official Rules and other terms expressly incorporated by reference, constitute the agreement governing use of PickMaster.
